Lee Rousso will appear in court today to argue for the legalization of online poker. While he will be in the King Country Superior Court, PPA members will be outside the justice halls holding a rally in his support.
The constitutional challenge is based on the argument that the ban violates the Commerce Clause of the United States Constitution. It is congress only that can regulate interstate commerce, not states legislatures.
Also in the rally will be poker stars Andy Bloch and Barry Greenstein.

Swiss casinos boost casino profits
Very good economic times have led to a nice year for Swiss casinos, according to the country’s industry association.
Gaming profits for Switzerland’s 17 casinos reached SFr908.8 million ($861.34 million) in 2007, a 5.4 per cent increase over the previous year. More than three quarters of this revenue came from slot machines and the rest from gaming tables.
The number of visitors also rose to five million from 4.7 million a year earlier, the Swiss Casino Association said on Tuesday.

The casino industry currently employs 2,400 people in Switzerland.
The industry also said it faces several challenges in the coming years including a possible smoking ban and new tax laws. Swiss establishments paid SFr482.2 million in tax last year, SFr26.2 million more than in 2006.

Online Gambling Ban Totally Unworkable
The Nevada director for the Poker Players Alliance - group with more than 1 million members nationwide and 12,870 in Nevada, are concerned to read that Sen. Jon Kyl, R-Ariz., wants to speed up enforcement of the vaguely and broadly written law banning Internet gambling - the Unlawful Internet Gambling Enforcement Act.
The confusion regulators are dealing with as they develop the regulations to enforce the law is a direct result of how this act was written and sneaked into a must-pass port security bill in the dead of night, allowing no time for review and debate.
One of the most egregious flaws in the bill is that it does not define *unlawful Internet gambling,* clearly something that legislation making Internet gambling unlawful should include.
This law is clearly unworkable, as regulators, bankers and several members of Nevada’s congressional delegation have publicly stated. To truly place checks and balances on Internet gambling, Congress should look to existing legislation that would seek to regulate online gambling in order to protect children and problem gamblers and collect the billions of dollars in lost tax revenue from these transactions.

Let’s not blame regulators for struggling to enact his flawed and ambiguous bill and start looking for workable solutions to truly regulate this growing online industry.

World Series of Poker finals moved back
The final table for the Main Event of the World Series of Poker has been moved to November, casino company and WSOP owner Harrah’s announced this week. The 117-day pause in the action will enable ESPN to provide a possibly same-day telecast, as opposed to past years in which the Main Event concluded in the summer and ESPN aired a tape-delayed broadcast months later.
The Main Event this year will begin July 3 and continue for several days until nine players are remaining for the final table. The final table will begin Nov. 9 and continue until just two players remain. Heads-up action will begin on Nov. 10 with a champion possibly not crowned until the early hours of Nov. 11.
ESPN will broadcast an edited version of the final table on Nov. 11 from 8-10 p.m.
“Our intent is to provide an even bigger stage for our players,” WSOP Commissioner Jeffrey Pollack said in a statement. “Now fans and viewers will ask ‘who will win’ our coveted championship bracelet instead of ‘who won.’ The excitement and interest surrounding our final nine players will be unprecedented.”
“The same day telecast will be a must see. Expect poker’s biggest names to come out, whether or not they’re playing. There will also be stars of film, television and music.”

The rest of the World Series of Poker, which runs from May 30 to July 14, remains unchanged. ESPN will begin airing its WSOP coverage on July 22, with two hours of programming every Tuesday through Nov. 11. The Nov. 4 show will be a one-hour final table preview that documents what the players have been doing during the break.

Poland Will Regulate Online Gambling
Poland’s Deputy Finance Minister Jacek Kapica has announced his government’s plan to regulate the online gambling industry. This is expected to take place by the end of 2008. The reasons behind the Polish change of mind was provided by Mr. Kapica when he said: ‘We cannot control this process anyway and it is better that the Budget at least derives some revenue from it.’
It seems as if Poland has sided with the more optimistic forecast.
The Government estimates that gross online gambling revenues could reach the high billion (as much as $48 billion by 2010).
Lastly - the pressure from Europe, the European Union (EU), and especially its Court of Justice seems practically insurmountable. Last year’s ECJ ruling that Italy may not use criminal law to ban online gambling sites based in European member countries will most likely influence other countries, in addition to Poland, already in coming months.

(Polish press sources have reported extensively on the Government’s attempts at possibly emulating Italy’s regulations on online gambling following the favourable ruling in the Placanica case by the European Court of Justice in March of last year).

Denmark regulate online gambling
The country is just one in a series of European Union countries that have come under intensive scrutiny for their stance related their monopolistic gambling practices. France, Holland and Germany are just a handful of nations under fire.

The Danish minister for taxation - Kristian Jensen - told the Danish national radio that the government was preparing to open up its previously monopolistic system in order to strictly regulate and licence suitable online gambling companies after months of pressure from the European Commission.

Following Barney Frank’s declaration on April 2, Reps. Luis Gutierrez (D-IL), Ron Paul (R-TX), and Pete King (R-NY) sent a letter Tuesday reminding the Treasury Secretary Henry Paulson and Federal Reserve Chairman Ben Bernanke of the ineffectiveness of the Unlawful Internet Gambling Enforcement Act (UIGEA).

(The letter - which was intended to stop all actions in favor of the ban, ends with a nice request of readers to become co-sponsors preventing UIGEA regulations of becoming the norm).

The Poker Players Alliance in full force
The Poker Players Alliance has been in full force - working to reach their goal of legalization of online poker games. The group has been working toward this goal with the hope that online poker will become legal or at least see an exception to the current laws. This week the group is expected to announce that they have reached the one million member mark. The group is based in Washington DC and is a pro-online poker group.
With the announcement the group will also be releasing the information of their new political action committee and a voter registration drive as well. The Poker Player’s Alliance has a campaign titled *If You Play - Have a Say campaign.* The group has invested largely in lobbying on Capitol Hill.
The PPA signed thousands of new members when the UIGEA bill was passed and since then membership has continued to climb. The PPA is hoping to raise at least $250,000 to fund the new political action committee this year. During this year’s WSOP the PPA will have representatives at the event that will be able to give information about the group, sign people up as members and also register voters for the upcoming presidential election. People will also be able to email members of Congress from the WSOP event by using computer terminals the PPA will have available.

Hopefully the movement will continue and the PPA will be able to gain more members this year and provide a driving force at this year’s most important election. Not only for online poker rights but also many major factors that are on the line with this year’s election.

U.S. warned not to implement UIGEA
Barney Frank and his pals have sent an official letter to U.S. Treasury and Federal Reserve officials telling them *not to waste any more time trying to implement a ban on online gambling*.
In other words - they are giving a direct order not to enforce the UIGEA! (UIGEA = Unlawful Internet Gambling Enforcement Act)
This is awesome news, but don’t get too excited just yet - as there is still a long way to go. For one thing - don’t expect any US-based banks to start processing any gambling transactions anytime soon, as that is still technically against the law.

But the good news is that this edict might hopefully serve to bolster the confidence of offshore processors to start opening their doors to American Players again. After all - if the offshore processors know the US banks are no longer required to monitor the transactions, and both sides know that that the offshore operations are not technically doing anything illegal - then why not start accepting credit cards again?

Calvin Ayre has quit at Bodog
Calvin Ayre announced Monday on Bodog’s website that he has quit…..!!!!????
Calvin Ayre - now 47, became involved in the online gambling industry in the late 1990-s, and introduced Bodog in 2000. By 2006 - Bodog-company was generating more than $7 billion US in wagers, making it the seventh-largest online gambling company in the world.
(That same year - Forbes magazine featured Ayre on the cover of its March issue as one of the world’s 794 billionaires. People magazine named him one of its 40 hottest bachelors).
However, Ayre’s departure will mean no operational change at Bodog. Alwyn Morris and the Morris Mohawk Gaming Group took ownership of Bodog in North America in 2007 and will continue to run the company. -’I was really more of a brand ambassador for Bodog the past while’ - he said on the Bodog website.
Regardless of who actually owns the company, the announcement that ownership has transferred to the Kahnawake Reserve - which the Mohawks consider to be sovereign soil, could help insulate the firm from prosecution.

Brandi Hawbaker Tribute
Brandi Hawbaker (Poker Player) found dead - She was only 26. Her body was found Sunday - April 13 - 2008, in a residence in the 8700 block of Pershing Drive in Playa Del Rey, Cali. An autopsy ruled her death as a suicide.
According to Brandon Gerson - a friend and former boyfriend of Ms. Hawbaker, she suffered from a *very serious untreatable mental illness* and had visited doctors in several states seeking help within the last year-and-a half.
The funeral will take place in Nashville - and will be private. Ms. Hawbaker will be creamated and her ashes will be scattered in one of the oceans as requested.

She first captured the attention of the poker world with a 35th place finish at the Festa Al Lago V in October, 2006.
Hawbaker poker career included only $40,000 in tournament winnings but she was better known as a central figure in a number of drama-filled episodes on various internet forums.

Block Internet Gambling Ban
A bill just introduced in the House of Representatives would effectively block the federal government from enforcing the Unlawful Internet Gambling Enforcement Act of 2006.
Stating that the Internet Gambling Enforcement Act infringes on two basic rights of importance to Americans, “the ability to do with their money as they see fit, and the freedom from government interference with the Internet,” Reps. Barney Frank (D-MA) and Ron Paul (R-TX) introduced the bill H.R. 5767 which would forbid the Treasury Department and the Federal Reserve from creating or implementing any regulation that would require the financial industry from blocking Internet gambling transactions.
These regulations are impossible to implement without placing a significant burden on the payments system and financial institutions - stated Rep. Frank in a press release!
The regulations and underlying bill also force financial institutions to act as law enforcement officers. This is another pernicious trend that has accelerated in the aftermath of the Patriot Act, the deputization of private businesses to perform intrusive enforcement and surveillance functions that the federal government is unwilling to perform on its own - added Rep. Paul.
